Delivery is available only in our designated delivery areas. Delivery times are estimates and may vary based on factors such as weather conditions, traffic, and order volume. We strive to deliver orders within the estimated time frame but cannot guarantee specific delivery times.

3.4 Order Cancellation

Once an order has been placed and payment has been processed, cancellation may not be possible as food preparation begins immediately. Please refer to our Refund Policy for more information.

You represent and warrant that:

• You own or control all rights to the User Content you post
• The User Content is accurate and not misleading
• The User Content does not violate these Terms and Conditions, any applicable law, or anyone's rights

We have the right, but not the obligation, to monitor, edit, or remove any User Content at our sole discretion.

7. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. Pizza 73 makes no representations or warranties of any kind, express or implied, regarding the operation of our Services or the information, content, materials, or products included on our Services.

To the fullest extent permissible by applicable law, Pizza 73 disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Pizza 73 does not warrant that our Services, its servers, or email sent from Pizza 73 are free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Pizza 73 shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or inability to use our Services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on our Services
• Any other matter relating to our Services

In no event shall Pizza 73's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Pizza 73 in the last six months, or, if greater, one hundred dollars ($100).

You agree to indemnify, defend, and hold harmless Pizza 73, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing our Services using your account.

We may terminate or suspend your account and bar access to our Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms and Conditions.

If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
